1. General Conditions.
1.1 Our commitment to privacy. This Privacy Policy (the “Privacy Policy”) indicates the information that Albaugh Chile Agroquímica Limitada (hereinafter, “Albaugh Chile” or “Us”) may collect and the use that may be given to that information. It also explains the security measures implemented to protect the information, the possibility of the Holders to access their information, and who they may contact at Albaugh Chile so that their queries in relation to this Privacy Policy are addressed, and so that any other matters that may arise in this regard are resolved.
1.2. This Privacy Policy complements the General Terms and Conditions of Use of the Site and the Cookies Policy. Everything expressed in this Privacy Policy is in strict compliance with the provisions of Law No. 19,628 on the Protection of Private Life and its concordant regulations (“LPVP”).
1.3. This Privacy Policy is only applicable to this site. If the Data Subjects visit another site that is not operated by Albaugh Chile, by clicking on advertisements or third-party links, it is recommended that they review the privacy statement published on the corresponding site and thus be informed about the personal information that may be collected through that particular site and how it will be processed.
1.4. The user declares and acknowledges that the use of this Site implies the acceptance of this Privacy Policy.
2. Application of this Privacy Policy.
2.1. This Privacy Policy applies to the Personal Data provided to Albaugh Chile by its Data Subjects and to the Processing of Data, as such terms are defined in article 2 of the LPVP.
2.2. The person responsible for the registration or database of the user when using the Site is Albaugh Chile Agroquímica Limitada. The Information will be processed directly by Us, ensuring that appropriate confidentiality standards are applied. The above is without prejudice to Albaugh Chile's duty to communicate or transmit the Information to third parties, in accordance with current regulations or at the request of a competent authority.
2.3. The processing of Personal Data will be done respecting the principles of purpose, confidentiality and security, as established by the LPVP.
3. Personal Data and authorization of use.
The Information processed by Us may include Personal Data from sources accessible to the public; Personal Data collected by Albaugh Chile with the consent of its Owners; Personal Data provided to Albaugh Chile within the framework of a contractual relationship with the Owners; and/or Personal Data collected by Albaugh Chile in compliance with a legal obligation.
4. Collection, storage and purpose of use of Personal Data.
4.1. The user expressly declares that the Information provided is precise, exact, updated and truthfully reflects his/her real situation.
4.2. The Data Subjects accept and give their free, express and informed consent for said Personal Data to be processed by Us for the purposes for which it was collected.
4.3 By way of example, Albaugh Chile may require Personal Data of employees, contractors, suppliers and/or clients to: evaluate job applications; manage all aspects of the employment relationship with the employee; develop personnel plans; maintain records of illnesses and occupational health programs; protect the safety of Albaugh Chile's clients, staff and property; investigate and respond to claims against Albaugh Chile and its clients; conduct employee opinion surveys; manage the termination of the employment relationship; maintain data on emergency contacts and beneficiaries; and comply with applicable laws, including court or administrative orders regarding individual employees.
4.4. In this regard, Albaugh Chile may require and process Personal Data to enter into and execute contracts; have contacts for negotiations and meetings; provide services and send information about events, new products, training and advertising; Conducting business, including development, operation and maintenance of systems commissioned by clients; responses to customer/supplier inquiries; and analysis based on questionnaires to improve products and services.
5. Communication of Personal Data.
5.1. As indicated above, Personal Data will be disclosed only for the purposes set forth above and in the manner permitted by the LDPD.
5.2. Albaugh Chile may subcontract third parties for the processing and treatment of Information. Thus, the Holder declares to know, accept and authorize that by providing Personal Data, it is possible that the Information may be processed by third parties contracted for this purpose by Albaugh Chile.
In these cases, Albaugh Chile will inform such third parties of their obligation to protect and maintain the confidentiality of the Personal Data with appropriate security measures, prohibiting them from using the Personal Data for their own purposes or for purposes not authorized by the Owners and preventing them from disclosing the Personal Data to third parties, obliging them to destroy the Personal Data after the provision of the services has concluded.
5.3. The nature of our activity and operations does not require the international transfer of personal data. If the need to make international data transfers occasionally arises, we will take measures to ensure that there is a legal basis for such transfer and that adequate protection is provided to the Personal Data as required by the LPVP
5.4. Albaugh Chile reserves the right to disclose any Personal Data it has about an Owner if a court forces it to do so or at the request of a government entity, or if Albaugh Chile considers it necessary or convenient to comply with the law or to protect or defend the rights or property of Albaugh Chile. Likewise, Albaugh Chile reserves the right to retain Personal Data and process such information to comply with current accounting and tax regulations.
6. Protection of Personal Data.
6.1. To prevent unauthorized access, keep the Information updated and ensure the correct use of Personal Data, Albaugh Chile has provided physical, electronic, administrative and security procedures to safeguard and secure the Personal Data collected.
6.2. However, the Owners recognize that the existing technical means that provide security are not impregnable, and that, even when all reasonable security precautions are adopted, it is possible to suffer manipulation, destruction and/or loss of information.
6.3. Albaugh Chile employees who misuse Personal Data and violate this Privacy Policy may be subject to disciplinary sanctions by Albaugh Chile, in accordance with the LPVP, labor laws and other applicable regulations.
7. Updating and accessing Personal Data.
7.1. The Holder may request Albaugh Chile in writing to review, modify, delete and update his/her Personal Data, in accordance with the procedure provided for this purpose by the LPVP and exercise the right of access, rectification, cancellation, opposition, as well as any other right conferred by the LPVP.
7.2. The right of access to the data may be exercised free of charge by the interested party as long as the corresponding information is requested at intervals of no less than 6 (six) months, in accordance with art. 12 of the LPVP.
7.3. To exercise his/her rights, the Holder must send an email to: infoweb@albaugh.com.ar, detailing his/her name and surname, identity card number, his/her request and the reasons that justify the exercise of his/her right. Once the stated requirements have been met and if applicable, Albaugh Chile will respond to the request within the period established in the LPVP.
7.4. Likewise, if the Holder subscribes to any of the services or communications offered by Albaugh Chile, such as advertisements or newsletters, he/she may request the suspension of said subscription at any time in accordance with applicable law, following the instructions included in each communication.
8. Implementation of the Privacy Policy. Training of Albaugh Chile staff.
8.1. Albaugh Chile will make its best efforts to disseminate this Privacy Policy - as well as other rules and/or procedures that it may establish to protect Personal Data - among its employees. In addition, Albaugh Chile will adopt measures to make the Privacy Policy easily accessible to the general public.
8.2. Albaugh Chile will ensure that its executive staff recognizes the importance of protecting Personal Data, training them and establishing rules for the management of said information so that it is used and protected appropriately and ensuring that said management system is put into effect.
8.3. In the event of incidents in the security and/or maintenance of the databases it maintains, Albaugh Chile will try to identify the causes in order to adopt corrective measures.
9. Minors.
The Site and the products and services of Albaugh Chile are aimed at persons over 18 years of age. Given the importance of protecting the privacy of minors, Albaugh Chile does not collect, store, process, use or intentionally treat information relating to minors, without the prior and verifiable consent of their legal representative. Said legal representative has the right, upon request, to review the information provided by the minor and/or to demand its update, modification or elimination.
10. Confidentiality.
Albaugh Chile will not sell, lease, assign or share Personal Data except in the ways established in this policy and the LPVP. Albaugh Chile will make its best efforts to protect the privacy of the information, without prejudice to the fact that by virtue of court orders or legal regulations, we are compelled to reveal information to government authorities, in which case Albaugh Chile cannot be held responsible for said disclosure of Information.
11. Data Conservation
We may only retain personal data for as long as necessary to provide a service that you have requested or for which you have given us your consent, unless otherwise provided by court order, law or regulation.
12. Use of cookies.
The Site may use a tracking system using "cookies" so that access to information, when moving from page to page, is done more quickly. It also helps in some cases to identify Users, without having to ask them for the access key again and again. These cookies are small files sent by the visited page and stored on the computer's hard drive, taking up little space.

13. Change of control.
In the event of a merger or acquisition with/by another company, Albaugh Chile may share the Information in accordance with this Privacy Policy. In any case, this Privacy Policy will apply to the new combined entity and legal successor of Albaugh Chile.
